When your spouse makes financial threats during a divorce

Posted Jan 15, 2014

On behalf of Morris, Downing & Sherred, LLP posted in Divorce on Wednesday, January 15, 2014.

What is a person to do when their spouse makes threats during a divorce? New Jersey residents who are going through a divorce know how emotionally challenging the situation can be. Many times there are disputes between spouses over countless items including finances, housing, children and so on.

Fortunately, there are several things people can do when faced with financial threats from their spouse during the divorce process. Physical threats are always a serious matter, but financial threats can be just as ominous. The first tip regarding a spouse who rants is to keep a written record of the threats. This record will make it easy to share information with the divorce team regarding the party’s activities. Second, it’s important to make sure that the divorce process and what the law says regarding divorce issues are understood. Comprehending all of the divorce legal issues can help a person feel confident.

Third, husbands and wives may rant about certain things, but noting the difference between these rants and actual actions is important. Some will lie and cheat and even hide assets, so remaining vigilant is important. Fourth, it’s generally not helpful to escalate the situation by returning the threats. Finally, the divorce team should be kept up to date with the situation. They can help with legal advice, therapy and financial matters.

New Jersey residents who are going through a divorce should consider consulting with a legal professional skilled in family law. These professionals can help people negotiate the complex divorce legal issues and make sense of the process. Issues like child support, alimony, and property division can be quite complicated and having a fair settlement is crucial for future support and success.

When a woman is going through a divorce, her husband may make many financial threats. The same can be true if the genders are reversed. Being prepared for these threats and having reassurance that all will be ok is important in creating and maintaining a non-threatening divorce.
