Brian C. Lundquist

Partner

Brian C. Lundquist concentrates his practice on Workers Compensation and complex civil litigation, including commercial disputes, high-value estate litigation, and commercial and residential landlord representation.  Since joining the firm in 2010, Mr. Lundquist has developed, and emphasizes, an objective-oriented, “no-nonsense” approach to his advocacy, fiercely devoted to securing the best outcomes for his clients.

On behalf of injured workers, Mr. Lundquist and his team utilize every means to ensure that any unpaid wages or medical treatment due his clients are fully and timely provided by their employers.  This extends to navigating additional benefits and compensation his clients may be entitled to after treatment, or if an injured worker needs more care in connection with a prior workplace injury.

For his litigation clients, which have ranged from international corporations to individuals, Mr. Lundquist applies nearly twenty years of courtroom experience developed both inside and out of state and federal courts throughout New Jersey and New York.  From outset through verdict, he has skillfully utilized his deep understanding of all aspects of trial work, leaving no matter unattended, with a primary focus on posturing all his clients’ unique cases for success.

A past president of the Sussex County Bar Association, Mr. Lundquist is frequently appointed by the New Jersey Superior Court to assist with estate disputes, guardianship proceedings, as well as other contested matters before the court.  Mr. Lundquist has been recognized for his achievements in the law, including being selected as Sussex County Professional Lawyer of the Year by the New Jersey Commission on Professionalism in the Law, 2024-2025.

Prior to joining the firm, Mr. Lundquist served as law clerk to the Hon. Edward V. Gannon, Presiding Civil Judge, Morris-Sussex Vicinage for the 2009-2010 term, as well as judicial extern to the Hon. Joel Schneider, U.S.M.J. U.S. District Court, District of New Jersey, 2008.  Before attending law school, Mr. Lundquist worked for nearly three years as a paralegal in complex securities litigation at the law firm of Williams & Connolly LLP in Washington, D.C.

Representative Experience

Workers Compensation

  • Secured lifetime “wage replacement” payments for the widow of deceased worker whose employer initially denied that the injury occurred at work.
  • Successfully negotiated “total disability” benefits on behalf of an employee who suffered catastrophic, career-ending spine injuries, the extent of which were first disputed by their employer.
  • Obtained additional treatment and surgery on a client’s behalf whose authorized physician overlooked diagnostic evidence of a second injury incurred in the same accident.
  • Secured cost-free, future care and medical supplies for an employee who suffered a debilitating foot/ankle injury, even after the client moved out of New Jersey.
  • Assisted numerous clients in successfully pursuing “occupational” workplace injury claims (i.e. repetitive stress, carpel tunnel, etc.) not the result of a single traumatic event.
  • Assisted numerous clients with securing employer-paid medical treatment and temporary wages following an employee’s reinjury or reaggravation of a prior workplace injury.
  • Through motion practice, obtained a favorable court decision commanding an employer to provide emergent, limb-preserving surgery on a client’s behalf initially denied by their employer.

Civil Litigation and Corporate Representation

  • Successfully assisted numerous commercial and residential landlord clients with lease formation, negotiation and enforcement through eviction.
  • On summary judgment, dismissed complaint filed against national telecommunications corp. client by individual landowner seeking to invalidate a region-critical telecommunications easement.
  • Successfully negotiated and resolved concurrent investigations conducted by New Jersey and New York State Attorney General Offices into corp. client’s interstate business practices, resulting in modest restitution obligations only pre-complaint.
  • On behalf of individual consumer, brought consumer fraud, breach of warranty and product liability claims against global auto manufacturer resulting in enforcement of existing warranties, as well as an award of damages and attorneys fees on his client’s behalf.

Estate & Probate Litigation

  • Successfully assisted numerous clients with defending improper attempts to invalidate duly executed Wills, Powers of Attorney, and Health Care Directives.
  • Defended to dismissal complaint brought by adult children seeking control over senior citizen client’s finances, legal decisions and freedom of choice in residential placement.
  • Successfully defended against state agency’s overreach in seeking to have vulnerable client deemed “legally incapacitated in all areas,” resulting in limited guardianship only and largely preserving the client’s right to self-determination.
