VCF awards are determined based on a formula that takes into account the severity of the individual’s physical injuries or illnesses, as well as their economic losses resulting from the 9/11 attacks or their aftermath.
The VCF uses a two-part calculation to determine the award amount. The first part of the calculation considers the non-economic losses, such as pain and suffering, and assigns a point value to each claim based on the severity of the injury or illness. The more severe the injury, the higher the point value.
The second part of the calculation considers the economic losses, such as lost earnings and medical expenses. The VCF uses a formula to determine the economic loss award amount, which is based on the individual’s age, income, and the extent of their economic losses.
Once the non-economic and economic loss amounts have been calculated, they are combined to determine the total award amount. The maximum amount that an individual can receive from the VCF is currently $250,000 for non-economic losses, and there is no cap on economic losses. However, these amounts may be adjusted based on the availability of funds in the VCF.
