You do not have to be married 20 years for alimony to be a factor in your divorce. Many short-term marriages can result in alimony obligations. If alimony applies to your divorce, it is important to come up with the right solution to fit your needs.

Types Of Alimony

New Jersey recognizes four types of alimony: permanent alimony, rehabilitative alimony, limited duration alimony and reimbursement alimony.

Permanent alimony is self-explanatory, and is awarded in long-term marriages where one spouse did not pursue a career or passed up educational opportunities to support the marital enterprise. Rehabilitative alimony lasts for a fixed period of time, and is intended to allow a spouse to re-enter the job market. Limited duration alimony lasts for a fixed period of time, and may be appropriate when the court determines that a permanent award is not warranted. Reimbursement alimony is appropriate in circumstances where one spouse supported the other while he or she obtained an advanced education.

The different types of alimony may be combined to arrive at a plan that is fair to both parties. In making an alimony award, the court considers the following factors:

  • The actual need and the ability of the parties to pay
  • The duration of the marriage
  • The age, physical and emotional health of the parties
  • The standard of living established in the marriage and the likelihood that each party can maintain a reasonably comparable standard of living
  • The earning capacities, educational levels, vocational skills and employability of the parties
  • The custodial responsibilities for the children of the party seeking alimony
  • The equitable distribution of property ordered
